TERMS + CONDITIONS OF CONSIGNMENT
This Consignment Agreement (the “Agreement”) is entered into as of the date set forth below by and between WASHED & WORN KIDS CURATED CONSIGNMENT (“W+W”) and the individual listed on the 'New Consignor Form' (“Consignor”). All consignment of childrens clothing or other items are subject to the terms and conditions set forth below. W+W reserves the right to refuse consignment of any items. By your indication that you 'Agree to the Terms + Conditions' on the New Consignor Form, you indicate your agreement to the following terms and that you are the lawful owner of all the merchandise you are sending to us. This agreement can be terminated upon receipt of written notice signed by you. This is a binding and valid legal contract.
TERMS + CONDITIONS
ITEMS/BRANDS
ITEM LIMIT:
+ There is a limit of fifty (50) items per consignment appointment. If you have more that 50 items to consign please set up an additional date once your items have been picked up.
+ If more than 50 items are submitted for consignment at one time, only 50 will be taken.
CONDITION/BRAND:
+ All clothing must be clean, freshly laundred and folded. Free of odours (strong household, smoke, pet, etc), alterations and pet hair.
+ We are no longer accepting "playwear" items. Items will now be categorized as "with flaw", but must be in Like New, Excellent or Very Good condition otherwise. No items with extreme fading, stains, holes or missing parts please.
+ Any items without size labels must have an accompanying note indicating what size it is.
+ Items that fall outside our list of accepted brands or accepted items will not be considered for consignment and can either be donated to a charity of W+W's choosing or returned along with any unsold items at the end of the consignment period for a delivery fee that will be deducted from your payout.
+ W+W will not accept any items that have been recalled.
+ PLEASE NOTE: IT IS ILLEGAL TO BUY OR SELL COUNTERFEIT GOODS. W+W WILL NOT BUY OR SELL COUNTERFEIT ITEMS AND WILL IMMEDIATELY DESTROY ITEMS DEEMED COUNTERFEIT.
OPTION #1: TRADITIONAL CONSIGNMENT:
PICKUP
+ Items must be placed in waterproof bags for pickup (ex. plastic shopping bag or garbage bag). Bags will not be returned.
+ The "Pickup Slip" (emailed at time of pickup date confirmation) or hand written version must be completed + attached to the bag. If there is no Slip or it is not filled out, unchosen/unsold items will automatically be donated.
+ Upon receipt, W+W will be responsible for the care and customer service associated with selling your items. This includes authentication, resale price evaluation, photography, internet listing, secure packaging, shipping, delivery, etc. Items may be used in promotional photos and marketing (social media and print).
CONSIGNMENT PERIOD LENGTH
+ Consignment period is a minimum of 120 days + will end on the 1st or 15th of the month.
+ Once we calculate 120 days from your upload date, if it falls between the 1-15 day of the month, your term will expire on the 15thof the month. If it falls between the 16 – end of month, your term will expire on the 1stof the following month.
+ The consigner will be responsible for contacting W+W to request their payout.
+ If a payout is not requested within one year of the term expiry date, the payout will only be available as a store credit, with no option for cash payout.
PRICING/PAYOUT
+ All prices will be set and adjusted by W+W, at our sole discretion. Items listed on the site can, at W+W’s discretion, become part of any promotion, sale, flash sale or pop-up shop.
+ You will receive fifty percent (50%) of the sales price for your items if you choose to receive store credit. You will receive forty percent (40%) of the sales price for your items if you choose to receive cash payment.
+ After your consignment period, you can choose one of two options. You will indicate the option on the pickup slip provided. (If no option is chosen, the items will automatically be donated):
1. Have any unsold items + items not chosen for consignment donated to a local charity of W+W’s choosing.
2. Have your unsold items + items not chosen for consignment returned to you for a delivery fee that will be deducted from your payout.
+ Store credit for your amount earned will be honored at anytime. Store credit cannot be used to pay for sales tax or shipping.
+ Payout amounts will be sent via e-transfer to the email address on file.
OPTION #2: HAVE YOUR ITEMS BOUGHT OUTRIGHT BY W+W
+ W+W will sort through your items + determine which ones we would like to purchase. You will have the choice of receiving 25% of the W+W resale price as cash or 35% as store credit .
+ DONATE or RETURN: You can choose to have the items not chosen for purchase donated or returned (please leave an additional bag for your unchosen items to be left in).
+ You will receive an email within one week of pickup letting you know your buyout totals.
By agreeing to these Terms, you agree to receive emails regarding your status as a consigner including updates to the Terms, Payout information and any other relevant information regarding consignment with W+W.
